About these terms
These terms are an agreement between you and The IT Dept Pty Ltd (ABN 12 665 405 505), “we” or “us”. They cover the Possum iPhone app and the Possum website. By using Possum, you agree to them. Our privacy policy explains how we handle your information, and the subscription terms cover Possum Plus.
What Possum is (and isn’t)
Possum is a price intelligence service. Every night it checks the prices that Coles, Woolworths and ALDI publish on their websites, and uses them to show you prices, price history, insights, alerts and smarter shopping lists.
We’re intelligence, not a store. Possum doesn’t sell groceries, take orders, handle payment for groceries or guarantee that anything is in stock. When you buy groceries, you’re buying from the supermarket, on its terms.
Prices and insights
- Prices come from the supermarkets’ websites. Every price in Possum shows when it was checked. Prices may have changed since then.
- Your store can differ. In-store prices, specials and stock can differ from the website, and between stores. Always check the price at the shelf or checkout before you buy.
- Mistakes can happen. A supermarket’s website can show a wrong price, a check can fail, or we can match two products that aren’t quite the same. When a check fails, Possum says so rather than hiding it, but we can’t promise every price is accurate or current.
- Insights are estimates, not promises. Things like “usually half price about every 6 weeks”, “good time to buy”, “might be worth waiting”, stock-up hints, savings figures and suggestions to split your shop are worked out from prices we’ve seen before. The past doesn’t guarantee the future. They aren’t financial advice.
- Supermarkets decide their own prices. We can’t make a supermarket honour a price shown in Possum.
Not affiliated with any supermarket
Possum isn’t affiliated with Coles, Woolworths or ALDI. Coles, Woolworths, ALDI and their product names and logos are trade marks of their owners. We use them only to tell you which supermarket and product a price belongs to. That use doesn’t mean any of them endorse Possum.
Your account
- You can start with a guest account, or sign in with Apple. You must be at least 16 to use Possum, or have a parent or guardian’s permission.
- Keep your device secure. You’re responsible for what happens in your account.
- An account is for one person. Use a household to share lists with the people you live with.
Using Possum fairly
Possum is for your own personal, non-commercial use. Please don’t:
- copy, scrape or harvest Possum’s prices, history or insights in bulk, or resell them;
- reverse engineer, overload or interfere with Possum, or get around its limits or security;
- misuse household invites, for example by selling them or sharing them publicly;
- use Possum to break the law or to harm anyone.
Your content
Your lists, pantry, recipes and notes are yours. You let us store, copy and process them only to run Possum for you, including sharing them with your household when you choose to. If you paste in a recipe from somewhere else, make sure you’re allowed to use it.
Our content
The Possum app, website, design, the possum character and the price history and insights we compile belong to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, for as long as you follow these terms.
Subscriptions
Possum is free to start. Possum Plus is a paid subscription bought through Apple’s In-App Purchase, with a 1-month free trial. It renews automatically each month until you cancel in iOS Settings, and refunds are handled by Apple. A Household subscription shares Plus with the members you invite. The subscription terms have all the details and form part of these terms.
Your consumer rights
Our services come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees, or any other right you have under law that can’t be excluded.
Limits on our liability
As far as the law allows:
- Possum is provided “as is”. Beyond the guarantees mentioned above, we don’t promise that prices, insights or suggestions are complete, accurate or current, or that Possum will always be available.
- We aren’t liable for indirect or consequential loss, or for losses that come from relying on a price or insight that turned out to be different at the shelf.
- Where our liability for a failure to meet a consumer guarantee can be limited, it’s limited to supplying the service again, or paying the cost of having it supplied again.
- Otherwise, our total liability to you is limited to the amount you paid us for Possum in the 12 months before the claim.
Changes to Possum and downtime
We’re always working on Possum, so features will change, and some may be added, moved between Free and Plus, or removed. If a change takes away something you’ve paid for, we’ll tell you first. Possum may sometimes be unavailable, or a night’s price checks may fail. When that happens, the app tells you.
Ending your use of Possum
- You can stop using Possum at any time, and delete your account in the app (Account, then Delete account). Deleting your account doesn’t cancel an App Store subscription. Cancel that in iOS Settings.
- We may suspend or close an account that seriously or repeatedly breaks these terms. Where it’s reasonable, we’ll warn you first and give you a chance to fix things.
- If we ever shut Possum down, we’ll give you reasonable notice.
Changes to these terms
We may update these terms. We’ll change the effective date at the top, and if a change is significant we’ll tell you in the app or by email before it takes effect. If you keep using Possum after that, the new terms apply. If you don’t agree, you can stop using Possum and cancel your subscription.
Apple
These terms are between you and us, not Apple. Apple isn’t responsible for Possum or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any applicable warranty, you can tell Apple, and Apple may refund the purchase price (if any). Apple isn’t responsible for any claims relating to Possum. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and we agree to the non-exclusive jurisdiction of the courts of New South Wales.
